Supreme Court Enforces Strict 60-Day Outer Limit for IBC Section 62 Appeals

Lose before the NCLAT and want to go to the Supreme Court? The clock is already running. An appeal under Section 62 IBC gets 45 days to file, with a possible 15-day grace period on sufficient cause, and nothing after that.

The Supreme Court has not made new law on this point. It has repeated what the Insolvency and Bankruptcy Code, 2016 says. Appeals from the Appellate Tribunal lie to the Supreme Court on questions of law. Parliament fixed 45 days for filing, allowed another 15 days on cause shown, and drew a hard line at 60 days.

Speed is the reason. A resolution plan gets approved, liquidation is ordered, a creditor's claim is decided, and money and management change hands. If an appeal could arrive months later, the process would wobble. The 60-day outer limit protects finality.
