On October 29, 2026, the Delhi High Court set aside a Central Information Commission order that had asked its registry to compile data on judgments reserved but not pronounced within two months by former judge Justice A K Sikri. Justice Amit Mahajan said timely pronouncement of judgments is plainly a matter of public concern. But the RTI Act, 2005, he held, gives access to information already available with a public authority. It does not force the authority to create new information or compile data it does not maintain. Public interest cannot compel that creation.
For RTI applicants, journalists, law students and litigants in India, that line between disclosure and creation will shape how requests about judicial functioning are framed in future.
