Women lawyers and legal professionals working across India's courts and tribunals may soon have access to a dedicated sexual harassment prevention framework designed specifically for the judicial ecosystem. In October 2026, a Supreme Court bench comprising Justice BV Nagarathna and Justice Augustine George Masih made a critical observation: the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, cannot be applied in a "straitjacket manner" to women in the legal profession.
This pronouncement marks a turning point in how courts address workplace safety for female advocates, judges, court staff, and other legal professionals. The bench identified a significant gap in existing protections. The 2013 Act, while foundational, had regulations specific only to the Supreme Court's own precincts. High Courts, District Judiciary, Tribunals, and quasi-judicial authorities operated without comparable, comprehensive frameworks tailored to the unique working environment of the legal system.
