Injunctions in Indian civil litigation are classified into two categories: temporary (interim) and permanent. Temporary injunctions, governed by Order 39 of the Code of Civil Procedure, 1908, are granted during the pendency of a suit to preserve the status quo and protect the subject matter from waste, damage, or alienation. They remain in effect until the disposal of the suit or further court orders. In contrast, permanent injunctions are granted by decree after final judgment on merits, regulated by Sections 38-42 of the Specific Relief Act, 1963, and restrain a party indefinitely from performing specified acts. The procedural distinction is critical: temporary injunctions may be granted at any stage of litigation, including ex-parte applications, while permanent injunctions require full hearing and adjudication of the suit. Understanding this dichotomy is essential for litigants seeking interim relief, as the grounds, duration, and legal consequences differ significantly between the two forms.
